# DoseTracker Terms of Service

**Draft for owner and qualified legal review — do not publish until bracketed items are completed.**
Effective date: **[EFFECTIVE DATE]**
Operator: **[LEGAL NAME OF OPERATOR]** (“we,” “us,” or “our”)
Contact: **[LEGAL/SUPPORT EMAIL]**; **[POSTAL ADDRESS IF REQUIRED]**

## 1. Acceptance and scope

These Terms govern your use of the DoseTracker application (the “App”). By installing, opening, or using the App after these Terms are made available to you, you agree to them, subject to applicable law. If you do not agree, do not use the App. **[CONFIRM HOW AND WHERE TERMS ARE PRESENTED AND WHETHER AFFIRMATIVE ACCEPTANCE IS REQUIRED.]**

The App is a local medicine-organization tool. You can create profiles for yourself and people whose medicines you manage, enter medicines and schedules, record dose activity, review history, and configure device reminders. The current App does not require an online account or subscription. Profiles in the App are local records; they are not separate sign-ins.

## 2. Who may use the App

You must meet **[MINIMUM AGE AND/OR PARENT/GUARDIAN RULE]** and be legally able to agree to these Terms. If you enter information about another person, you must have **[CONFIRM REQUIRED AUTHORITY OR CONSENT STANDARD]** to do so. You are responsible for deciding who may access the device and the profiles you create on it. Switching between profiles does not require a separate credential.

## 3. Medication information and reminders

You provide the medication names, doses, instructions, schedules, stock amounts, and dose-status entries in the App. Check that this information is accurate and current. The App does not verify a prescription, decide whether a medicine or dose is appropriate, check interactions, diagnose a condition, or replace advice from a qualified clinician or pharmacist. Follow your care team's instructions. For a medical emergency, use the appropriate emergency service.

The App can request local notifications for supported ongoing daily and selected-weekday schedules. Other schedules can be saved for tracking without an automatic reminder. Notifications require device permission and depend on operating-system settings, channel settings, alarm access, battery behavior, device state, and other factors outside the App's control. A notification may be late or may not appear. Snoozing changes the reminder time; it does not record that a dose was taken. Use another dependable method when timely medication is critical. The App's reminder-status screen reports problems it can observe while scheduling or checking permissions; it cannot confirm delivery of every notification.

## 4. Your data, profiles, and device access

The App stores the profiles, medicine details, schedules, dose records, and preferences you enter on your device. We do not claim ownership of information you enter. The current App does not provide an operator-hosted account or cloud backup for that information. You are responsible for keeping your device secure and for deciding who may use it.

Optional app lock uses the fingerprint, face, PIN, pattern, or passcode configured on your device. Anyone whose biometric credential is enrolled on that device, or who knows its screen lock, may be able to open the App. App lock does not encrypt the App's health database or files you export. Notification content may appear on a locked screen depending on your App and system privacy settings; the initial App preference is to show content. Review those settings if other people can see your device.

The App's export and restore feature covers **preferences only**. It does not back up profiles, medicines, schedules, or dose history. If you export a preferences file and choose a sharing destination, that copy leaves the App's control and the destination may have its own terms and privacy practices. You are responsible for copies you share or store outside the App. **[LINK TO SEPARATE PRIVACY NOTICE.]**

## 5. Appropriate use

Use the App only for lawful purposes and with information you are entitled to enter. Do not interfere with the App's operation or try to bypass its device security features. The App enforces some input and file-size limits needed for local operation; it does not offer a hosted service with user accounts or server rate limits.

## 6. Software and third-party components

Subject to these Terms and applicable law, you may install and use the App for your personal medicine organization and care-management purposes. **[CONFIRM APP COPYRIGHT OWNER, DISTRIBUTION LICENSE, AND ANY OPEN-SOURCE CARVE-OUTS BEFORE PUBLICATION.]** Nothing here transfers ownership of the App's software, design, or marks to you. Any third-party or open-source component remains subject to its applicable license.

The App relies on your device's operating system for notifications, alarm permissions, biometric/device authentication, photo selection, file selection, and sharing. The provider of your device, app store, or a sharing destination may apply its own terms to those separate services. We do not control their settings or availability.

## 7. Ending use and deleting local data

You may stop using the App at any time. Within Settings, “Erase all data” attempts to remove the App's local profiles, medicines, schedules, dose history, preferences, app-lock setting, and stored profile photos and to cancel its notifications. An interrupted or failed erase may require retrying. Deleting an individual medicine also deletes its associated schedule and recorded history. Archiving a profile keeps its local data but stops supported reminders for it. Copies you already exported or shared outside the App are not removed by in-app erasure.

The current App has no operator-hosted account to close or remotely suspend. **[CONFIRM WHETHER THE OPERATOR WANTS TO RESERVE A FUTURE RIGHT TO STOP DISTRIBUTING OR SUPPORTING THE APP; DO NOT ADD REMOTE-SUSPENSION LANGUAGE WITHOUT A PRODUCT CHANGE.]**

## 8. Availability and warranties

The App is provided **[CONFIRM JURISDICTION-APPROPRIATE “AS IS” / WARRANTY LANGUAGE]**. We do not promise uninterrupted operation, accurate user-entered information, or on-time or successful delivery of every reminder. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded. **[COUNSEL TO CONFIRM REQUIRED CONSUMER-WARRANTY WORDING FOR DISTRIBUTION MARKETS.]**

## 9. Liability

To the extent permitted by applicable law, **[INSERT COUNSEL-APPROVED LIMITATION OF LIABILITY, INCLUDING ANY CAP, EXCLUSIONS, AND REQUIRED EXCEPTIONS]**. Nothing in these Terms limits liability or remedies that the law does not permit us to limit. The App's reminder limitations in Section 3 are important when deciding whether and how to use it for time-sensitive medication.

## 10. Changes to the App or these Terms

We may update the App or these Terms. If we change these Terms, we will make the revised text and its effective date available **[CONFIRM IN-APP / STORE / OTHER NOTICE METHOD AND ANY ADVANCE NOTICE REQUIRED BY LAW]**. A change will take effect only as permitted by applicable law. If you do not agree to a revised version, stop using the App and use its local erasure control if you wish to remove its data from that device.

## 11. Governing law and disputes

These Terms are governed by **[GOVERNING LAW]**, except where mandatory law in your location applies. Courts in **[VENUE]** will hear disputes, subject to any mandatory consumer right to bring a claim elsewhere. **[CONFIRM WHETHER A DIFFERENT DISPUTE PROCESS IS LEGALLY APPROPRIATE; NONE IS INCLUDED HERE.]**

## 12. Contact

Questions about these Terms may be sent to **[LEGAL/SUPPORT EMAIL]** or **[POSTAL ADDRESS IF REQUIRED]**.

## Reviewer notes — remove before publication

- Resolve every bracketed item, especially legal operator, eligibility/caregiver authority, effective date, governing law/venue, warranty/liability terms, contact details, IP license, privacy notice, and notice/acceptance mechanism. See `OPEN_QUESTIONS.md`.
- Confirm that the free, offline, accountless, non-AI product facts in `PRODUCT_FACTS.md` still match the exact release build. Re-audit if billing, cloud sync, analytics, clinician services, or automated recommendations are added.
- Fix the absolute “Never miss a dose” and “never run out” UI claims before release. Those claims conflict with reminder and stock-alert implementation limits; disclaimers here do not correct misleading product copy.
- Confirm the app's copyright/license; the current repository `LICENSE` names Expo. Add appropriate third-party notices and a separate health-data privacy notice.
- This is a code-informed drafting aid, **not a substitute for review by a qualified attorney before publication**, including jurisdiction-specific health, consumer, privacy, and medical-device questions.
